Welcome to JourneyGen AI. Please read this Terms of Use Agreement ("TOU Agreement") carefully. By accessing or using https://journeygen.ai/ or any other websites, mobile applications, or services provided by JourneyGen AI, Inc. ("JourneyGen," "we," or "our"), you acknowledge that:

1. You have read, understand, and agree to be bound by this TOU Agreement.
2. You are of legal age to form a binding contract.
3. If acting on behalf of an entity, you have authority to bind that entity to this TOU Agreement.

The term "you" refers to the individual or entity accessing JourneyGen's services.

Certain services offered by JourneyGen may be subject to additional terms ("Supplemental Terms"), which are incorporated herein. This TOU Agreement, along with applicable Supplemental Terms, constitutes the entire agreement (the "Agreement") between you and JourneyGen.

For clarity, the following definitions apply:

• "JourneyGen Properties": Collectively, all JourneyGen platforms, including websites, applications, and services.
• "Service(s)": Any functionality, feature, or offering available through JourneyGen Properties, such as travel reservations or AI-powered itineraries.
• "User": Individuals or entities who access JourneyGen Properties.
• "Content": All information, data, and materials, whether provided by Users or JourneyGen, on JourneyGen Properties.
• "Travel Services": Includes but is not limited to reservations for flights, accommodations, and related travel logistics.

We may modify this Agreement at any time. Updated terms will be posted on https://journeygen.ai/. Material changes will be communicated via email to registered users. Continued use of JourneyGen Properties constitutes acceptance of the updated Agreement.

1. Eligibility
   You must be at least 18 years old to use JourneyGen services.
2. Account Registration
   To access certain features, you must create an account by providing accurate and complete information. Keep your credentials secure, as you are responsible for all activities under your account.
3. Restrictions
   You agree not to:
   • Copy, modify, or distribute JourneyGen Properties without authorization.
   • Use JourneyGen Properties for unlawful purposes.
   • Interfere with the functionality or security of JourneyGen Properties.

These terms apply to JourneyGen's Travel Reservations Services:

1. Reservations and Supplier Terms
   By booking Travel Services through JourneyGen, you agree to the terms and conditions of our third-party suppliers. In case of conflict, JourneyGen's terms take precedence regarding our liability and responsibilities.
2. Pricing and Availability
   Prices are subject to change until bookings are confirmed. Errors in pricing or descriptions may result in reservation adjustments or cancellations.
3. Cancellations and Refunds
   Cancellations and refunds are subject to the policies of the respective travel service provider. JourneyGen facilitates but does not control such policies.
4. Travel Requirements
   It is your responsibility to secure passports, visas, vaccinations, and other travel-related documentation.
5. Liability
   JourneyGen acts as an intermediary between Users and travel service providers. We are not responsible for the performance or failure of third-party services.
   

All rights, title, and interest in JourneyGen Properties, including trademarks, software, and content, remain the exclusive property of JourneyGen or its licensors.

JourneyGen Properties are provided on an "as-is" and "as-available" basis. We disclaim all warranties, express or implied, to the fullest extent permitted by law.

To the extent permitted by law, JourneyGen's liability is limited to the amounts paid by you for JourneyGen services in the 12 months preceding the claim.

This Agreement is governed by the laws of the state of California. All disputes will be resolved through binding arbitration in Santa Clara, California.
